Key facts

  • Prosecutors allege Brinksman, a contractor for a U.S. government agency, disclosed classified national defense information to his romantic partner, who publishes a Substack newsletter.
  • The affidavit identifies the journalist only as Individual 1, but excerpts match a September 28 Capital & Empire newsletter piece by Aída Chávez.
  • Aída Chávez's profile says she worked for the Nation and other outlets before launching the newsletter.
  • A LinkedIn profile bearing Brinksman's name lists work for Deloitte as a manager and senior strategy security consultant.

The FBI took Ian A. Brinksman, 42, into custody at his residence on Friday, Oct. 23, 2026, after a search, and accused him of illegally sending national defense information. National defense information is classified material concerning the nation’s military and intelligence security.

Prosecutors say Brinksman, working for a U.S. government agency as a contractor, gave classified national defense information to his romantic partner, who publishes a Substack newsletter. Substack is a newsletter publishing platform. The complaint and affidavit state that Brinksman kept opening classified intelligence reports and staying in touch with the journalist. Investigators rely on phone records, database access logs, badge-swipe records, e-mails and other material linked to Brinksman.

Starting in 2020, Brinksman was an employee of a federal agency located in the Eastern District of Virginia. In 2022, he became a developer who handled systems integration for Company 1, a firm working for the same agency. Systems integration means connecting separate computer systems and software so they work together.

Brinksman possessed a Top Secret security clearance that included Sensitive Compartmented Information access throughout the period covered by the complaint. Sensitive Compartmented Information is a classification level for highly restricted intelligence data. Top Secret denotes a high classification level for national defense information. A security clearance is a vetted authorization to view classified information.

John A. Eisenberg, an assistant attorney general, said Brinksman went beyond his assigned duties to get closely held secrets and give them to a romantic partner. “That is not carelessness,” Eisenberg said. Eisenberg called the conduct a betrayal of his oath and of the American people who trusted him.

The affidavit asserts that Individual 1 put out Substack articles at least five times in 2026 that mirrored classified reports, with some material at the top secret level. A fundraising article that Individual 1 reportedly published in September 2026 claimed she had produced reporting drawing on classified government agency assessments. Individual 1 used her social media profile to say she accepts leaks.

The affidavit names the journalist only as Individual 1, yet excerpts line up with a Capital & Empire newsletter item from Sept. 28, 2026 by Aída Chávez. The profile ties her to the Nation and other outlets prior to the newsletter launch. Chávez did not reply right away to an e-mail asking for comment.

Todd Blanche, the attorney general, said national defense information stays classified to shield Americans from harmful actors. Kash Patel, the FBI director, said guarding America’s secrets ranks as a leading counterintelligence goal and those who betray trust face serious consequences. Counterintelligence is work that tries to block spying and other threats from foreign powers.

John Ratcliffe, the CIA director, said the FBI took a CIA services contractor into custody after the agency referred the matter and that leaks are not tolerated at all. Ratcliffe said releasing classified material without permission creates serious dangers for national security, intelligence sources, current operations and officers. An agency referral is a formal request from one government body for another to investigate.

Eli Ross and Kathryn DeMarco, trial attorneys with the National Security Division’s Counterintelligence and Export Control Section, handle the prosecution. Vito Iaia, an assistant U.S. attorney for the Eastern District of Virginia, is prosecuting, while Tejpal Chawla and Stuart Allen, assistant U.S. attorneys for the District of Columbia, assist. An assistant U.S. attorney is a federal prosecutor who handles criminal cases for the Justice Department.

The FBI Chicago Field Office runs the investigation with major help from the Washington Field Office. The complaint contains only accusations, and Brinksman is considered innocent until the government proves guilt beyond a reasonable doubt. A complaint is a formal charging document that starts a criminal case. The Justice Department released the news as Press Release Number 26-1256 from the Office of Public Affairs.

A LinkedIn page under Brinksman’s name lists Deloitte work as a manager and in senior strategy security consulting. The same page says he previously served the State Department in a foreign service officer role. A foreign service officer is a U.S. diplomat who represents the government abroad.

Deloitte has not yet answered requests for comment. The State Department said it needs more time before offering a comment. A federal public defender for Brinksman refused to comment. A federal public defender is a government-paid lawyer who represents people who cannot afford an attorney.
